Terms and Conditions: Share Your Schwinn Story Contest

(Colorado Limited Liability Company)

Entity: Schwinn Doc LLC, a Colorado Limited Liability Company (“Company,” “we,” “our,” “us”)
Program: Share Your Schwinn Story / Schwinn Memory Giveaway (“Program”)

1. Acceptance of Terms

By submitting any photo, video, written story, memory, or other content (“Submission”) through theschwinndocumentary.com or any affiliated upload form, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.

If you do not agree, do not submit.

2. Eligibility

You must:

  • Be at least 18 years old
  • Submit content you fully own or control
  • Grant all required rights (defined below) to the Company
  • Reside in a jurisdiction where such contests are legally permitted

Void where prohibited.

3. Ownership of Submission

You represent and warrant that:

  • You are the lawful owner of the Submission
  • All individuals visible have provided consent, OR the image is of yourself/your family from your personal collection
  • The Submission does not infringe on any copyright, trademark, privacy right, or third-party interest
  • No AI-generated, AI-altered, or AI-manipulated content is included
  • The Submission is not materially photoshopped or modified beyond basic photo corrections

Allowed edits: exposure, color correction, contrast, white balance, grain, crop, saturation, film-style toning.

Not allowed:

digital manipulation, generated elements, added objects, removed objects (except safety blurring), compositing, AI tools, or any alteration that changes the factual nature of the photo.

The Company reserves the right to disqualify or remove any Submission that violates these standards.

4. Rights Granted (License & Release)

By submitting, you grant Schwinn Doc LLC an irrevocable, worldwide, royalty-free, perpetual license to:

  • Use, reproduce, display, distribute, adapt, edit, publish, publicly perform, or otherwise exploit the Submission
  • Use your name, likeness, and story as part of the Submission
  • Use the Submission across all forms of media, including but not limited to:
    • Social media
    • Promotional campaigns
    • Advertising
    • The documentary film “NO HANDS: The Wild Ride of the Schwinn Bicycle Company”
    • Theatrical, digital, streaming, broadcast, home entertainment, festival, and educational releases
    • Exhibit, distribute, or monetize the Submission as part of the Program

This license extends to all territories worldwide and applies in perpetuity.

You waive any right:

  • to inspect or approve use
  • to royalty, payment, or compensation
  • to attribution or credit (though we may credit at our discretion)
  • to withdraw consent after submission

5. Use of Submissions

The Company reserves the right to:

  • Feature selected Submissions in promotional materials
  • Share them across Company-owned social channels
  • Use them for marketing, publicity, or fan engagement
  • Use them in or around the documentary, including future sequels, spinoffs, and companion media
  • Archive and store the content indefinitely

By submitting, you explicitly authorize use across any promotional and social channels now known or hereafter devised.

6. Raffle / Prize Details

By entering a Submission, you are automatically entered into the Program’s giveaway.

Prizes include:

  • 1st Place: A verified vintage Schwinn bicycle
  • 2nd, 3rd, 4th Places: Physical hardcover books signed by the authors
  • 5th–10th Places: Digital editions of the book

Prizes are non-transferable, non-exchangeable, and hold no cash value.

Winners are chosen at Company discretion based on story impact, authenticity, and creative merit.

Company reserves the right to modify, postpone, or cancel the giveaway if necessary.

7. Release of Liability

You release and hold harmless:

Schwinn Doc LLC (Colorado LLC), its officers, directors, partners, employees, agents, distributors, successors, and assigns

from any claim, liability, or action arising from:

  • Submission use
  • Misuse by third parties
  • Public distribution
  • Publication
  • Editing
  • Archival
  • Any appearance in the documentary or related media
  • Emotional distress, publicity issues, or copyright/takedown disputes

You agree to indemnify the Company against all claims arising from breach of your warranties.

8. Content Review and Disqualification

The Company may remove or disqualify Submissions that:

  • Violate copyright
  • Are defamatory, obscene, harmful, or unlawful
  • Contain AI manipulation
  • Include third-party brands, logos, or proprietary marks with unresolved rights
  • Pose privacy risks
  • Are intentionally misleading or altered

Company decisions are final.

9. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law rules.

Exclusive jurisdiction lies in the state and federal courts of Colorado.

10. Modifications

We may update or modify these Terms at any time.

Continued use or participation constitutes acceptance of revised terms.
